Legislation
470. Officers holding pensionable posts are governed by the following legislations:
(a) The Pensions (1938) Act (Cap 58) (in the case of Officers who have elected
to remain subject to the provisions of this Act.
(b) The Pensions Act, 1983.
(c) The Widows and Orphans Pensions Act (Cap 80).
Reduced Pension and Gratuity
471. An Officer may elect to receive on retirement a gratuity and reduced
pension under the provisions of Regulation 16 of the Schedule to the Pensions
(1938) Act (Cap 58) or to Regulation 24 of the second Schedule of the Pensions
Act 1983.
Advance Payment of Gratuity on Retirement
472. An Officer may apply to the Permanent Secretary for Finance to draw
up to 75% of his computed pension gratuity upon proceeding on pre-retirement
leave.
Cases of Death or Injury
473. (a) If an Officer is injured or dies in the performance of his duty
in circumstances which may subsequently lead to a claim for a special pension
award to the Officer or to his dependents in accordance with the Pensions
Act 15)83, the Permanent Secretary or Head of Department must at once report
full particulars of the death or injury on the prescribed form to the Secretary
for the
Public Service for investigation of the circumstances.
(b) All injuries by accident sustained by an Officer during and in the course
of his employment incapacitating such Officer from performing his duties for
a period of at least three (3) consecutive days, must be reported on the prescribed
Accident Report Form by the Permanent Secretary or Head of Department.
(c) An Officer on shift duties, all overtime performed on Saturdays, Sunday
and Public Holidays will be remunerated at rate II or compensated by the grant
of time-off as per (b) above examination and treatment.
(d) A report of death of an Officer in the course of employment must be forwarded
on the prescribed form to the Permanent Secretary for Labour and Industrial
Relations.
Preparation of Pension Forms
474. Application forms for pensions on the retirement of an Officer must
be submitted in triplicate to the Secretary for the Public Service not later
than three (3) months prior to the date of the Officer's departmental personal,
leave and salary files, which should include a summary of the leave position
and the calculation of leave due prior to retirement. The computation and
authorization of pensions and gratuities must be treated as urgent matters
and must be accorded priority. As far as possible, authority for the payment
of a pension and/or gratuity should be given before the date of an Officer'
s retirement.
Widows and Orphans Pension Act
475. Section 11 of the Widows and Orphans Pension Act (Cap 80) provides for
a monetary penalty in the event of a contributor failing or neglecting to
supply to the Ministry of Finance the
information specified in Section 10 of the Act.
