Establishment of the Public Service Appeals
Board(PSAB)
The PSAB was established following promulgation of the 1997 Constitution.
Section 151 of the Constitution states that:
"The Parliament may make laws:
- providing for appeals against specified decisions of the Public Service
Commission;
- constituting the body to hear the appeals; and
- making such other provision as is necessary or desirable in connection with
the operation of the appeals systems"
Part 5 of the Public Service Act 1999 revives the PSAB established by the
Public Service (Ammendment) Act No. 58 of 1998. The Public Service Appeal
Board is established to ensure that fairness and basic human rights are observed
at times. The Public Service (Appeal) Regulations 1999 makes it possible from
1 July 1999 to commence and operate the PSAB.
The PSAB is vested with the responsibilities of hearing appeals made by salaried
officers of the Public Service against specific decisions of the Public Service
Commission. Every officer other than an officer on probation, has the right
of appeal and may appeal to the Appeal Board against the:
- promotion of any employee, or the appointment of any person who is not
an employee to a position in the public service for which the appellant, had
applied by way of promotion;
- taking of disciplinary action against the appelant;
- transfer of the appelant from one district to another within the Fiji Islands.
